Dakota County Family Court Filing Fees

Dakota County follows the fee schedule set by the Minnesota Judicial Branch, with some local additions for the law library surcharge. Filing fees apply when you start a new case or respond to one. Fees must be paid at the time of filing unless you qualify for a waiver.

Current filing fees for common family court case types in Dakota County:

  • Dissolution of Marriage (Divorce): $405.00 ($340 base + $50 other + $15 law library)
  • Custody, Paternity, or Parenting Time: $325.00 ($310 base + $15 law library)
  • Legal Separation or Annulment: $375.00
  • Motion or Response to Motion: $100.00

Copy fees are set statewide. Plain (uncertified) copies are free. Certified copies cost $14.00 per document. Exemplified copies cost $14.00, or $28.00 if you need both certified and exemplified. These copy fees apply whether you request documents in person or by mail. If you are mailing a request, send a check or money order payable to District Court Administrator and include a self-addressed stamped envelope.

People with low income can ask for a fee waiver by filing an In Forma Pauperis (IFP) request. You need to show the court your financial situation. If approved, filing fees are waived or deferred. Forms and self-help guidance are available at the courthouse or through the statewide self-help center resources at mncourts.gov/self-help.

Dakota County Family Court Records

Family court records in Dakota County include several different case types. Dissolution of marriage (divorce) is the most common. The file typically contains the petition, summons, financial affidavits, any agreements reached, and the final judgment and decree. That judgment spells out property division, custody, parenting time, child support, and any spousal maintenance ordered by the court.

Custody and parenting time cases have their own files separate from divorce when the parents were never married. Paternity cases establish the legal father of a child and often include child support and custody orders. Child support modification cases arise when someone asks the court to change a prior support order. All of these are types of family court records you can search through MCRO or request from the Dakota County court offices.

Minnesota Statutes Chapter 518 governs dissolution of marriage, including grounds, residency requirements, and property division. Chapter 518A covers child support calculations. Custody and parenting time standards are set out at Minn. Stat. 518.17, which requires courts to make decisions based on the best interests of the child. These laws apply in Dakota County just as they do across the state.

Some records are restricted. Juvenile proceedings, adoption files, mental health commitment cases, and anything sealed by court order are not available to the general public. Financial documents like tax returns and Social Security numbers are redacted before copies are released. Parties to a case generally have broader access to their own files than non-parties do.

Filing Family Court Cases in Dakota County

To file a family court case in Dakota County, at least one spouse or party must live in the county. Under Minnesota law, you file in the county of residence. The process starts with completing the right forms and paying the filing fee at one of the court locations.

Dakota County offers e-Filing through the Minnesota Judicial Branch electronic filing system. This lets attorneys and some self-represented parties file documents online without coming to the courthouse. For dissolution cases, the petitioner files the Petition for Dissolution of Marriage along with a Summons. The other party must be served with these documents. Once served, they can file a response.

When children are involved, both parents are typically required to complete a parenting education class. The court schedules an Initial Case Management Conference (ICMC) within 30 to 60 days of filing. At the ICMC, a judicial officer reviews the case status, discusses timelines, and may refer the parties to mediation. Settlement of motions is encouraged throughout the process. If the parties agree on everything, they can file a Marital Termination Agreement and often resolve the case without a trial.

Note: Self-Help Centers are available at Dakota County court locations to assist people who do not have a lawyer and need help with forms or understanding the process.
