Family Court Filings in Morrison County
Morrison County District Court handles the full range of domestic relations cases. Dissolution of marriage is the most common. Minnesota uses a no-fault standard under Chapter 518. You file where you live. One spouse must have lived in Minnesota for at least 180 days before filing. The only ground for dissolution is irretrievable breakdown of the marriage.
Custody and parenting time cases may come up as part of a dissolution or as separate actions when parents were never married. The court decides both legal custody (who makes major decisions for the child) and physical custody (where the child primarily lives). The best interests standard under section 518.17 guides these decisions. Parenting time schedules are set in the same case and can be modified later if circumstances change.
Child support calculations follow Chapter 518A. The formula takes into account each parent's gross income and their share of parenting time. The court can enter, modify, and enforce support orders. Paternity actions are filed when the legal father has not been established. They may lead to support, custody, and parenting time orders.
Cases involving children who need protection under Minnesota law are handled under Chapter 260C. These are filed through the same District Court. LawHelpMN at lawhelpmn.org has free guides on all these case types.
