Wright County family court cases follow Minnesota law. Dissolution of marriage falls under Minnesota Statutes Chapter 518. Minnesota is a pure no-fault state. You do not need to establish any fault by either spouse. The sole ground for dissolution is irretrievable breakdown of the marriage. One party files, serves the other, and the court takes it from there. Agreed cases can move faster. Disputes over property, custody, or support require hearings before a judge.
Child custody in Wright County is decided under the best interests standard in Minn. Stat. sec. 518.17. The court weighs the relationship each parent has with the child, the stability and suitability of each home, the child's ties to school and community, the physical and mental health of all parties, and each parent's willingness to foster a relationship between the child and the other parent. Both legal and physical custody are addressed. Wright County sees a range of custody arrangements given its mix of suburban and rural communities.
Child support is calculated using both parents' incomes and the parenting time schedule under Minnesota Statutes Chapter 518A. Work-related childcare and medical insurance costs can be added to the base support amount. Support orders stay in effect until modified. Either parent can bring a motion to modify support when a significant change in income or custody occurs. Modifications are filed back with the Wright County District Court.
Paternity cases establish legal fatherhood and open the door for custody and support orders in Wright County. Cases can be filed by either parent or by the county in cases involving public assistance. Once paternity is legally settled, the court can address all related parenting matters.
