Types of Family Court Records in Mahnomen County

Dissolution of marriage cases are the most common family court type in Mahnomen County. A dissolution file includes the petition, summons, financial affidavits, any settlement agreement, and the final judgment and decree. The judgment and decree covers property division, debt terms, any spousal support, and custody and child support terms. These cases are filed under Minnesota Statutes Chapter 518.

Custody and parenting time cases may be filed as part of a dissolution or separately by unmarried parents. The court applies the best interests standard under Minn. Stat. section 518.17. The court weighs each parent's ability to care for the child, the child's ties to each parent, the stability of the home, and the child's own preferences when appropriate. Orders can be changed later with a substantial change in circumstances.

Child support records document original orders, income calculations, and later changes. Paternity cases establish legal parentage under Chapter 518A. Once parentage is set, the court can enter support and custody orders in the same case file. Protection orders go through family court and are public records searchable through MCRO. Emergency orders can be issued the same day in urgent situations. All of these records are on file at the Mahnomen County Courthouse and most are available through MCRO for cases from 2015 onward.
