Family Law Cases at Nicollet County District Court

Nicollet County District Court handles the full range of family law cases under Minnesota statute. Dissolution of marriage follows Chapter 518. Minnesota requires only that the marriage has irretrievably broken down. No fault needs to be shown. One spouse must have been a Minnesota resident for at least 180 days. You file where you live.

Custody decisions use the best interests standard from section 518.17. The court looks at the child's relationship with each parent, the child's home and school stability, the mental health of all parties, and the ability of each parent to support the other's relationship with the child. Both legal and physical custody are determined in family court. Parenting time schedules are set by order and can be modified if circumstances change significantly.

Child support cases use the income shares formula under Chapter 518A. Both parents' gross incomes and their respective parenting time percentages factor into the calculation. Paternity actions establish legal parenthood when parents were not married. After paternity is established, the court can enter custody, parenting time, and support orders. Child protection cases are handled under Chapter 260C.

LawHelpMN at lawhelpmn.org has plain-language guides on all these case types tailored to Minnesota law. The Self-Help Center line at 651-435-6535 can also walk you through the process for the Fifth Judicial District.
