Family Court Cases in Redwood County
All dissolution of marriage cases in Redwood County follow Minnesota Statutes Chapter 518. You or your spouse must have lived in Minnesota for at least 180 days before filing. The case is filed in the county where either of you lives. Minnesota is a no-fault state. The only ground for divorce is irretrievable breakdown of the marriage relationship.
Child custody decisions are based on the best interests of the child as defined in Minn. Stat. Section 518.17. The judge looks at the quality of each parent's relationship with the child, each parent's ability to provide a stable home, the child's adjustment to home and school, and the child's preferences when applicable. Parents may agree on custody arrangements or submit the question to the court for a decision.
Child support follows the guidelines in Chapter 518A. The formula uses both parents' net incomes and the parenting time split. The court can deviate from the guideline amount when the standard calculation would be unjust given the specific facts. Modifications are available when there is a substantial change in income or parenting time.
Paternity cases establish legal parentage for unmarried couples. After paternity is established, the court can enter orders for custody, parenting time, and support. Forms for all these case types are available free at mncourts.gov/GetForms.aspx.
